VCAT
VCAT is an acronym which stands for the Victorian Civil and Administrative Tribunal. VCAT is a cheaper, quicker and much less formal way of dispute resolution. VCAT went into operation on the 1st of July 1998 and will only hear and deal with civil disputes and is made up of three division overall which is the Civil Division, the Human Rights Division and the Administrative Division which each deal with their own area of law. VCAT now hears over 90000 cases per year which outnumbers all of Victoria's courts combined.
The role of VCAT is to provide dispute resolution which can be easily accessed by people in the community along with being cost effective and time effective
Each division hears certain cases. The Administrative Division will hear General Lists which review decisions made by government agencies, Land Valuation List which hear applications by landowners to review land valuations or classifications, Legal Practice List which hears disputes between clients and lawyers, Planning and Environment List which hears appeals and applications about the development of land, Occupational and Business Regulation List which reviews decisions made by occupational and licensing bodies and the Taxation List which will hear appeals against the imposition of state taxes.
The Civil Division will hear matters from the Civil Claims List which will deal with disputes between buyers and sellers of good, Domestic Building List which hears disputes between owners and builders, Owners Corporation List which hears applications in relation to owners corporations, Real Property List which will deal with disputes regarding real estate, Residential Tendencies List that will hear disputes between landowners and tenants and Retail Tenancies List is the same as Residential Tenancies except it's between retail premises.
The Human Rights Division is the smallest division and deal with issues from the Anti-Discrimination List which deals with complaints about discrimination, Guardianship List will hear cases involving people who cannot make financial decisions for themselves, Health and Privacy List deals with complaints with access to private health records and the Mental Health List hear applications.
